    إثبات النسب بالبصمة الوراثية(DNA) بين الشريعة والقانون

    تناول البحث إثبات النسب بالبصمة الوراثية ما بين الشريعة والقانون ،وذلك من خلال مبحث وثلاثة محاور،تناولت ماهية البصمة الوراثية (DNA) ،واثبات النسب في الشريعة الاسلامية والقانون ،وحجية البصمة الوراثية في اثبات النسب ، وتنبع اهمية البحث من الاثر الكبير للبصمة الوراثية في مجال اثبات النسب ،وما ترتب عليه من اتساع دائرة الاثبات امام القضاء،اما مشكلة البحث تتمحور في ما اثارته البصمة الوراثية من جدل بين رجال الدين ،ما بين مؤيد له ادلته ومعارض له اسانيده ،وكل ذلك بمنهج مقارن وصفي تحليلي لما جاء في الشريعة من طرق لاثبات النسب والقانون ، واهم النتائج هي التزام معظم الدول الاسلامية بالطرق الشرعية لاثبات النسب ،وحصر استخدام البصمة الوراثية في حالات معينة ،واهم التوصيات هي ضرورة الاستفادة القصوىمن اكتشاف البصمة الوراثية واعتبارها ثورة علمية للطب الشرعي و نعمة من الله لخدمة الانسانية . Abstract The research paternity genetic fingerprint between the law andSharia, and through the Study of the three axes, dealt with the nature of the DNA, and proof of lineage in the Islamic Sharia law, and Authentic DNA to prove descent, stems importance of research of the great impact of genetic imprint in the field proof of descent, and the consequent widening of proof circle in front of the judiciary, while the problem of the research centered on what sparked the DNA of the controversy between the clergy, between supporter evidence and shows him isnaads, all in the methodology of comparative descriptive analysis of what came in the canon of ways to prove ratios and the law, and the most important results are the most Islamic States' commitment to a legitimate way to prove descent, and restricting the use of DNA in certain cases, and the most important recommendations is the need to make the most of the discovery of DNA and the mind of Forensic Medicine and a blessing from God to serve the humanity scientific revolution.
