    المتطلبات التشريعية لتفعيل الائتمان ألإيجاري في العراق دراسة استطلاعية في البيئة العراقية

    تأتي هذه الدراسة في محاولة لوضع إطار معرفي ومفاهيمي لموضوع الائتمان الايجاري واغناء القارئ والمستفيد بالمعلومات الوافية عنه وتقليص الفجوات المعرفية للمهتمين به من خلال قياس مدى ما هو متوفر وغير متوفر من المتطلبات الأساسية الخاصة بالقوانين العراقية لتفعيله في البيئة العراقية مع تحديد المتغيرات الرئيسة المؤثرة بصورة مباشرة على موضوع الدراسة .إذ تم استخدام أسلوب الدراسة الاستطلاعية من خلال توزيع استمارة استبيان على عدد من المختصين بالمجال القانوني والتشريعي العراقيين ذوي العلاقة بمجال الدراسة . وقد توصلت الدراسة إلى نتائج أهمها : أن الائتمان الايجاري يعود بالنفع على جميع الأطراف ذات العلاقة من المورد إلى المؤجر والمستأجر ولكن مع وجود المتطلبات اللازمة لتفعيله. أوصت الدراسة بضرورة تشجيع الاهتمام بنشاط الائتمان الايجاري في العراق عن طريق تحقيق المتطلبات اللازمة لتوفير البيئة المناسبة لتفعيله، من خلال التوجه نحو سن القوانين والتشريعات التي من شانها أن تساهم في تفعيل الائتمان الايجاري في المستقبل في البيئة العراقية وإصدار اللوائح والتعليمات الخاصة بذلك . ABSTRACT: This study comes in an attempt to develop a knowledge and conceptual frame work for the subject of Rental Credit and enrich the reader and beneficiary with adequate information about it and reduce the knowledge gaps of those interested in it by measuring the extent of available and unavailable basic requirements of Iraqi laws to activate it in the Iraqi environment Subject of the study. The method of exploratory study was used through the distribution of questionnaire to a number of specialists in the field of legal and legislative Iraqis in the field of study. The study found that the rental credit is beneficial to all the relevant parties from the supplier to the lessor and the tenant but with the necessary requirements to activate it. The study recommended the need to encourage attention to the activity of rental credit in Iraq by achieving the necessary requirements to provide the appropriate environment to activate it, Through the direction of enacting laws and legislation that would contribute to the activation of rental credit in the future in the Iraqi environment and the issuance of regulations and instructions for that.
