    قيود فتح الدعوى الجنائية الأثر المترتب على مخالفتها

    المستخلص تناولت الدراسة قيود فتح الدعوي الجنائية والاثر المترتب علي مخالفتها، إذ أن مخالفة هذه الضوابط والقيود تؤدي الي بطلان كافة الاجراءات الجنائية المتخذة ومن اهداف هذه الدراسة التعريف بالضوابط وقيود فتح الدعوي الجنائية ، وان ليس للنيابة والشرطة الجنائية الحرية المطلقة في فتح الدعوي الجنائية وان مخالفة الضوابط والقيود تودي الي البطلان في كافة الاجراءات المتخذة ابتداء من فتح الدعوي الجنائية ، وان تلك الضوابط والقيود ليس المقصود منها حماية الجناه والافلات من العقاب او المسوؤلية الجنائية ولكنها وضعت لحماية اصحاب الحصانات الموضوعية والاجرائية من الاجراءات الكيدية التي يتعرضون لها اثناء مهامهم الموكل اليهم لذا لايصح اصدار امر فتح الدعوي الجنائية في حالة وجود القيد الا بعد ازالته بالطريقة التي حددها القانون ومن هنا توصلت الدراسة الي توصيات لمعالجة القصور في فتح الدعوي الجنائية حتي لايوثر هذا القصور الي بطلان كافة الاجراءات الجنائية، وان اهمية هذه الدراسة تكمن في الالتزام القانوني للنيابة والشرطة الجنائية وتتمثل في عدم اصدار امر بفتح الدعوي الجنائية في حالة وجود القيد الا بعد ازالته بالطريقة التي حددها القانون حتي يكون التكيف سليم غير قابل للبطلان وضمان صحة الاجراءات الجنائية والاموامر المتخذة منذ فتح الدعوي الجنائية تبين أن تلك الضوابط والقيود متعلقة بالنظام العام وانها لوازم اجرائية لابد منها فان فتح الدعوي ليس بالامر الهين فله اثار اجتماعية ونفسية علي المتهم وذويه فلابد من العمل بتلك الضوابط والقيود الواردة في القانون لحماية المجتمع من الاجراءات الكيدية والمساواة اما القانون . Abstract The study has examined the controls and restrictions on opening criminal proceedings and the effect of violating them.
