    الفتاوى العدلية على أصح الروايات الشرعية (في الفقه الحنفي) للقاضي رسول بن صالح الأيديني الحنفي (ت 978 هـ) (من كتاب النكاح الى كتاب الإجارات) دراسة وتحقيق

    الحمد لله قاضي الحاجات، ومبلغ الغايات، والصلاة والسلام على رسول الله الداعي إلى الخيرات، والناهي عن المنكرات، وعلى آله وصحبه أهل الفضائل والمكرمات، ومَن تبعهم بإحسان على الإيمان والطاعات. وبعد: فهذه الأطروحة لمرحلة الدكتوراه بعنوان : (الفتاوى العدلية على أصح الروايات الشرعية لرسول بن صالح الأيديني دراسة وتحقيق) تهدف إلى تحقيق المخطوط الذي بقي قروناً لم يظهر بين الناس، وهو إضافة جديدة إلى المكتبة الإسلامية في (الفقه الإسلامي). ولضرورة المنهج العلمي جاءت الدراسة في مقدمة بينتُ فيها أهمية دراسة الموضوع، والنسخ المتوفرة من المخطوط وأماكن وجودها وبيان صفات تلك النسخ، ثم أعقبت المقدمة بقسمين وخاتمة، وفهارس، أما القسم الأول وهو القسم الدراسي فكان للتعريف بالقاضي رسول بن صالح الأيديني وكتابه (الفتاوى العدلية) من حيث عصر الإمام وحياته والتعريف بكتابه. أما القسم الثاني: النص المحقق ودراسة الكتاب دراسة علمية تميزت بتوثيق المسائل الفقهية ونسبتها إلى مصادرها الأصلية، وترجمة مَن ورد ذكر أسمائهم من أهل العلم، وتوضيح المصطلحات الفقهية والعلمية واللغوية، كما وعرفتُ الأماكن والبلدان التي ذكرها المؤلف في كتابه، ثم ختمتُ الرسالة بخاتمة جعلتها لأهم النتائج والتوصيات ومن أهم نتائج الدراسة أنها أظهرت مدى أهمية ثقافة المصنف واطلاعه على العلوم الشرعية المختلفة، مما أعطى صورة واضحة مدى ارتباط العلوم كالنحو والبلاغة والغريب بعلم الفقه، ثم ذيلت الأطروحة بثبت المصادر والمراجع العلمية. وفي الختام أوصي الاهتمام بالتراث الإسلامي، وإظهار المخطوطات القيمة الحبيسة في خزائن المخطوطات العالمية، بتحقيق نصوصها تحقيقا علميا وإخراجها بين يدي طلاب العلم، لتستفيد منها الأجيال ويعم النفع بها . وآخرُ دعوانا أنِ الحمدُ لله رب العالمين . Abstract Praise be on Allah, the fulfiller of the needs, the informer of the utmost and peace and prayer be upon prophet Mohammed, the caller for goodness, the interdictor of the abomination and all his kinsfolk and companions the owners of virtues and dignity and those who follow them upon faith and obedience. This dissertation is entitled "Justice Advisory Opinions According to the most Authentic Legal Citations of Rasul Bin Salih Al-Eidini: a Study and Investigation". It aims at investigating the manuscript which remained untreated for centuries by readers and researchers; it is a new contribution to the Islamic library (Islamic jurisprudence). Because of the importance of the scientific method, the study is divided into an introduction which indicated the importance of studying this topic, the available copies of the manuscript, where is it restored and the their features. The introduction was followed by two chapters, a conclusion and bibliography. The first chapter defines Imam Ralul Al-Eidini and his book entitled Justice Advisory Opinions so far as the Imam's age, his life and book. The second section investigates the manuscript in a scientific way by citing the jurisprudent issues tracing it to its original references and citing the biographies of scholars who lived at that age and explaining the jurisprudent, scientific and linguistic terms. The places and countries mentioned by the author were also defined. Then, the dissertation was ended with a conclusion of the most important results and recommendations followed by the bibliography list. As a result, I recommend to pay attention to the Islamic heritage, especially the precious manuscripts which are held back in the stalls, to be displayed to the students and knowledge seekers to get benefit from by the coming generations. At last, all praise and thanks are Allah's the Lord of alamin.
